These Artist / Seller Terms & Conditions (“Terms”) govern the relationship between ARTSSPOT and all Artists, Artisans, Designers, Self-Help Groups, Cooperatives, and Sellers (“Artist / Seller”) who supply products to ARTSSPOT.
✅ Acceptance of Terms (IMPORTANT)
By registering with ARTSSPOT, supplying products, or accepting any purchase order, all Artists / Sellers confirm that they have read, understood, and agreed to these Terms & Conditions.
Only Artists / Sellers who agree to these Terms & Conditions are eligible to sell or supply products to ARTSSPOT.
1. Definitions

Artist / Seller: Any individual or entity supplying products to ARTSSPOT

Artist Price: Fixed base price agreed between ARTSSPOT and the Artist

Purchase Order (PO): Order issued by ARTSSPOT for supply of products

Products: Handmade, hand-painted, or Madhubani-inspired goods
2. About ARTSSPOT
ARTSSPOT is a cultural commerce brand promoting authentic Madhubani art, handicrafts, textiles, and heritage products across India and internationally.
ARTSSPOT operates on a Buy–Sell (Principal-to-Principal) model, where ARTSSPOT purchases products from Artists and resells them independently.

3. Eligibility to Supply
Artists must:
- Be genuine artists, artisans, SHGs, MSMEs, or registered businesses
- Supply original, authentic, or legally licensed products
- Be legally competent to enter into a binding agreement
- Provide correct bank, identity, and tax details
ARTSSPOT reserves the right to approve, reject, or discontinue any Artist at its discretion.
4. Products Allowed
- Madhubani paintings (paper, canvas, fabric)
- Hand-painted sarees, suits, dupattas, shawls
- Bags, clutches, apparel, home décor
- Wall art, furnishings, cultural & spiritual items
❌ Prohibited:
- Copied or pirated designs
- Machine-printed items sold as handmade
- Mass-produced goods without disclosure
5. Handmade Product Nature
All products are handmade.
Minor variations in color, texture, or design are natural characteristics and shall not be treated as defects.
6. Intellectual Property Rights
- Artists retain ownership of their original artworks
- Artists grant ARTSSPOT a non-exclusive, royalty-free, worldwide license to use product images, videos, and descriptions for resale and marketing
- Any IP dispute shall be the sole responsibility of the Artist
7. Pricing, Purchase Model & Artist Payment
ARTSSPOT follows a Buy–Sell / Wholesale model.
- Artists declare a fixed Artist Price
- ARTSSPOT purchases products at the agreed Artist Price
- After purchase, ARTSSPOT has full rights to:
- Add its own margin or profit
- Decide the final retail selling price
- Offer discounts, promotions, or bundled offers
The Artist acknowledges that:
- The Artist Price is final and binding
- The Artist has no claim over ARTSSPOT’s retail price or profit
- The Artist Price includes all production costs
8. Purchase Orders & Supply
- Supply shall be against confirmed Purchase Orders
- ARTSSPOT may cancel orders in case of delays or non-compliance
9. Quality, Packaging & Inspection
- Products must match agreed quality standards
- ARTSSPOT may inspect and reject damaged or incorrect items
- Rejected goods may be returned at the Artist’s cost
10. Delivery & Risk
- Risk remains with the Artist until products are delivered to ARTSSPOT or its logistics partner.
11. Payments & Tax Compliance
- Payments are made after delivery acceptance
- Artists are responsible for GST registration, invoicing, and tax compliance
- Applicable deductions (TDS, bank charges) apply as per law
12. Returns, Defects & Adjustments
ARTSSPOT may return products in case of damage, defects, or incorrect supply.
Refunds or replacements may be adjusted against future payments.
13. Confidentiality
Artist pricing, designs, and commercial terms are confidential and shall not be disclosed to third parties.
14. Suspension & Termination
ARTSSPOT may terminate the relationship for fraud, IP violations, poor quality, or repeated non-compliance.
15. Limitation of Liability
ARTSSPOT is not liable for indirect losses, market fluctuations, logistics delays, or buyer misuse.
16. Force Majeure
Neither party is liable for delays due to events beyond reasonable control such as natural disasters, strikes, pandemics, or government actions.
17. Governing Law & Jurisdiction
These Terms are governed by Indian Law.
Jurisdiction: Madhubani, Bihar, India.
18. Amendments
ARTSSPOT may update these Terms at any time.
Continued supply implies acceptance of revised Terms.
